OFFICIAL RULES
NBCUniversal Inc.’s America’s Got Talent Radio Sweepstakes Rules
NO PURCHASE NECESSARY. A PURCHASE OR PAYMENT OF ANY KIND WILL NOT INCREASE YOUR
CHANCES OF WINNING.
1. Eligibility
NBCUniversal, Inc.’s America’s Got Talent Radio Sweepstakes (the “Promotion”) is open only to legal residents of the
FCC designated signal area of WDMK-FM who are at least eighteen (18) years old at the time of entry. Void in Guam,
Puerto Rico, the U.S. Virgin Islands, and other U.S. territories and possessions and where prohibited by law. Employees
of WDMK-FM, or any of its respective affiliates, subsidiaries, advertising agencies, or any other company or individual
involved with the design, production, administration, execution or distribution of the Promotion and their immediate
family (spouse, parents and step-parents, siblings and step-siblings, and children and step-children) and household
members (people who share the same residence at least three (3) months out of the year) of each such employee are
not eligible. The Promotion is subject to all applicable federal, state and local laws and regulations. Participation
constitutes entrant’s full and unconditional agreement to these Official Rules and Sponsor’s decisions, which are final
and binding in all matters related to the Promotion. Winning a prize is contingent upon fulfilling all requirements set
forth herein. The Promotion consists of a sweepstakes (the “Sweepstakes”).
2. Sponsor
Sponsor: WDMK-FM, 3250 Franklin, Detroit, MI 48207.
3. Sweepstakes Administrator
The Administrator of this Sweepstakes is Impact Marketing & Promotions, 19236 Cammie Lane, Tarzana, CA 91356.
4. Timing
The Promotion begins on May 7, 2012 at 12:00 a.m. Eastern Time (“ET”) and ends on May 14, 2012 at 11:59 p.m. ET
(the “Promotion Period”). Sponsor is the official time keeper for this Promotion.
5. How to Enter
To enter the Promotion follow the instructions broadcast periodically by WDMK-FM during the Promotion Period. Each
designated caller / entrant will be required to fulfill specific radio station requirements in order to enter and be eligible
to receive a prize. Multiple participants are not permitted to share the same email address. Any attempt by any
participant to obtain more than the stated number of entries by using multiple/different email addresses, identities,
registrations and logins, or any other methods will void that participant’s plays and that participant may be disqualified.
Use of any automated system to participate is prohibited and will result in disqualification. Sponsor is not responsible
for lost, late, incomplete, invalid, unintelligible or misdirected registrations, which will be disqualified. In the event of a
dispute as to any registration, the authorized account holder of the email address used to register will be deemed to be
the registrant or player. The “authorized account holder” is the natural person assigned an email address by an Internet
access provider, online service provider or other organization responsible for assigning email addresses for the domain
associated with the submitted address. Potential winners may be required to show proof of being the authorized
account holder. All entries become the sole and exclusive property of Sponsor and will not be returned.
6. Winner Selection:
On or about May 14, 2012, Sponsor, Sweepstakes Administrator or an independent judging agency will select one (1)
entry for each prize described below in Section 9 in a random drawing of all valid entries received. The entrant will be
contacted using the email address, telephone or mailing provided with the entry and may be awarded the prize (subject
to verification of eligibility and compliance with the terms of these rules). Sponsor’s decisions as to the administration
and operation of the Promotion and the selection of potential winners are final and binding in all matters related to the
Promotion. Winners will be notified by email, phone or mail on or about May 15, 2012. If contact by email, failure to
respond to the initial verification e-mail within three (3) business days of date of notification or return of e-mail
notification as undeliverable after three (3) attempts will result in disqualification.
7. ALL POTENTIAL SWEEPSTAKES WINNERS ARE SUBJECT TO VERIFICATION BY SPONSOR WHOSE
DECISIONS ARE FINAL AND BINDING IN ALL MATTERS RELATED TO THE PROMOTION.
8. Verification of Potential Winners
Potential winners must continue to comply with all terms and conditions of these Official Rules, and winning is
contingent upon fulfilling all requirements. The potential winners will be notified by email, telephone, or registered mail
after the date of random drawing. The potential grand prize winner (except where prohibited) will be required to sign
and return to Sponsor, within seven (7) days of the date notice is sent, an affidavit of eligibility, and liability/publicity
release and a Tax Acceptance Form ("Affidavit/Release") in order to claim his/her prize if applicable. If a potential
winner of any prize cannot be contacted, fails to sign and return the affidavit of eligibility and liability/publicity release
within the required time period (if applicable), or if the prize or prize notification is returned as undeliverable, potential
winner forfeits prize. In the event that a potential winner of a sweepstakes prize is disqualified for any reason, Sponsor
may award the applicable prize to an alternate winner by random drawing from among all remaining eligible entries.
Except where prohibited, potential Grand Prize winner will be required to execute an Affidavit of Eligibility, a Liability
Release and a Publicity Release, and a Tax Acceptance Form ("Affidavit/Release").
9. Prizes
Five (5) Daily Prizes: Each daily prize consists of one (1) Kindle Fire™. Approximate retail value of each Daily Prize
(“ARV”): One hundred ninety-nine dollars and no cents ($199.00). One (1) Grand Prize: Three (3) day, two (2) night
roundtrip for two (2) to New York City to attend one of five live performance tapings of America’s Got Talent to be held
on July 24, 2012, August 14, 2012, August 21, 2012, August 28, 2012 or September 4 2012. Trip includes:
Roundtrip coach airfare for two (2) on an airline of Sweepstakes Administrator choice from the major airport closest to
winner’s residence in the continental U.S. (as determined by Sweepstakes Administrator in Sweepstakes Administrator’s
sole discretion) to New York City; double-occupancy standard hotel accommodations for three (3) days/two (2) nights
(one room, double occupancy, room rate and tax only) at a hotel to be selected by Sweepstakes Administrator in
Sweepstakes Administrator’s sole discretion; one hundred dollars ($100) towards ground transportation in destination
city, roundtrip group transportation from hotel to taping, and two (2) tickets to attend a live performance taping of
America’s Got Talent. Winners are responsible for all taxes and fees associated with prize receipt and/or use. Any costs
associated with prize receipt and/or use that are not expressly stated above are not included in the Grand Prize and are
the responsibility solely of the winner and/or his/her travel companion, as the case may be. Such costs may include,
without limitation, ground transportation not specifically referenced as being a part of the Grand Prize, meals,
incidentals, tips, telephone calls, and other personal costs and expenses not specified herein but relating to the use or
acceptance of the Grand Prize. Winner may be required to present a valid credit card to cover any potential personal
costs at hotel at time of check in. Airline and hotel regulations and conditions apply. Travel, lodging and tickets are
subject to availability, certain restrictions, blackout dates and Sponsor’s approval and must be booked not less than
twenty five (25) days prior to the date of travel. No cash equivalent for the prizes, prizes are non-transferable and no
substitution will be made except as provided herein at the Sweepstakes Administrator’s sole discretion. Sweepstakes
Administrator reserves the right to substitute any listed prize for one of equal or greater value for any reason. Winner
must be able to travel on or before a designated taping date of July 24, 2012, August 14, 2012, August 21,
2012, August 28, 2012 or September 4 2012 and, following the establishment of the travel itinerary, such
is not subject to change. Grand Prize winner and his/her travel companion will be required to travel on the identical
itinerary, and are responsible for obtaining identification documents and/or other travel documents required for the trip,
as well as for complying with all other legal requirements for travel. Travel companion must be sixteen (16) years of
age or older before the time of travel. Sponsor or Sweepstakes Administrator will not replace any lost or stolen tickets,
vouchers, certificates or other prize items once they are in the winner's possession. Odds of winning a prize depend on
the number of eligible entries received during the Promotion Period. Approximate retail value (“ARV”) of the Grand Prize
is two thousand, two hundred fifty dollars and no cents ($2,250.00). Actual value of Grand Prize will vary depending on
point of departure and the seasonal fluctuation of hotel rates and airfares. Any difference between the actual value and
ARV of the Grand Prize will not be awarded. ARV of all prizes combined: three thousand two hundred forty-five dollars
and no cents ($3,245.00).
Winner and Guest must travel together on the same itinerary. If a Grand Prize element is not available for any reason,
as determined by Sponsor in its sole discretion, the remaining elements of Grand Prize shall be awarded and shall
constitute full satisfaction of Sponsor’s Grand Prize obligation to Winner and no additional compensation or substitution
will be awarded. Airline and hotel reservations are subject to availability and travel restrictions may apply. Travel and
hotel arrangements will be determined by Sweepstakes Administrator in its sole discretion. Once determined, no
change, extension, or substitution of dates is permitted, except by Sweepstakes Administrator in its sole discretion. No
other travel elements (including, without limitation, travel to and from the airport(s) near
Winner’s residence, additional ground transportation, luggage fees, insurance, gasoline, meals, gratuities, souvenirs,
etc.) are included in Grand Prize. Airline tickets are non-refundable, may not qualify for frequent flyer miles, are not
valid for upgrades and are not valid for business-related or group travel. Airline tickets are valid only for travel on the
airline(s) chosen by Sweepstakes Administrator in its sole discretion. Airline tickets will be issued only to Winner and
Guest. Winner is responsible for any tax liability, including applicable departure taxes or fees, inspection charges, and
security charges. Once issued, tickets are non-transferable and may not be reissued once travel has commenced. Open
tickets may not be issued and stopovers are not permitted. Winner and Guest is solely responsible for obtaining all
necessary travel documents including passports (if applicable). Sponsor and/or Sweepstakes Administrator is not
responsible for airline seat assignments, special meals, check-in procedures, and baggage limitations. Sponsor has no
responsibility for alterations to any travel plans caused by airline delays or for any act, omission or event. Sponsor and
Sweepstakes Administrator shall have no responsibility or liability for cancellations, delays, or any other change by any
company or person providing any element of Prize and are not responsible or liable for any expenses incurred as a
consequence thereof. Winner and Guest specifically release Sponsor and Sweepstakes Administrator from any and all
claims for loss or damage to baggage or property, or from personal injuries or death, or from loss or delay, arising out
of the acts, omissions, or negligence of any independent contractors, such as air carriers, hotels, restaurateurs,
transportation providers, medical personnel or other providers of services or facilities. If Winner chooses to take Trip
without a Guest, the remaining elements of Prize shall be awarded and shall constitute full satisfaction of Sponsor’s
Prize obligation to Winner and no additional compensation will be awarded. Guest, if any, will be required to execute
and return a release of liability and, except where prohibited, publicity release (collectively, the “Guest Documents”),
which must be returned with the Sweepstakes Documents, or Guest portion of Prize will be forfeited. Guest must be the
age of majority in his or her state of residency as of the first date of travel.
10. Entry Conditions and Release
By entering, each participant agrees to: (a) comply with and be bound by these Official Rules and the decisions of the
Sponsor and/or the Sweepstakes judges which are binding and final in all matters relating to this Sweepstakes; (b)
release and hold harmless the Sponsor or NBCUniversal, Inc. and each of their respective parents, subsidiary, and
affiliated companies, the prize suppliers and any other organizations responsible for sponsoring, fulfilling, administering,
advertising or promoting the Sweepstakes and Promotion, and all of their respective past and present officers,
directors, employees, agents and representatives (collectively, the “Released Parties”) from and against any and all
claims, expenses, and liability, including but not limited to negligence and damages of any kind to persons and
property, including, but not limited to, invasion of privacy (under appropriation, intrusion, public disclosure of private
facts, false light in the public eye or other legal theory), defamation, slander, libel, violation of right of publicity,
infringement of trademark, copyright or other intellectual property rights, property damage, or death or personal injury
arising out of or relating to a participant’s entry, creation of an entry or submission of an entry, participation in the
Sweepstakes and Promotion, acceptance or use or misuse of prize (including any travel or activity related thereto)
and/or the broadcast, exploitation or use of entry; and (c) indemnify, defend and hold harmless the Sponsor from and
against any and all claims, expenses, and liabilities (including reasonable attorneys fees) arising out of or relating to an
entrant’s participation in the Sweepstakes and Promotion and/or entrant’s acceptance, use or misuse of prize.
11. Publicity
Except where prohibited, participation in the Promotion constitutes winners consent to Sponsor’s and its agents’ use of
winner’s name, likeness, photograph, voice, opinions and/or hometown and state for promotional purposes in any
media, worldwide, without further payment or consideration.
12. General Conditions
Sponsor reserves the right to cancel, suspend and/or modify the Promotion, or any part of it, if any fraud, technical
failures or any other factor beyond Sponsor’s reasonable control impairs the integrity or proper functioning of the
Sweepstakes, as determined by Sponsor in its sole discretion. Sponsor reserves the right in its sole discretion to
disqualify any individual it finds to be tampering with the entry process or the operation of the Sweepstakes or to be
acting in violation of these Official Rules or any other promotion or in an unsportsmanlike or disruptive manner. Any
attempt by any person to deliberately undermine the legitimate operation of the Sweepstakes may be a violation of
criminal and civil law, and, should such an attempt be made, Sponsor reserves the right to seek damages from any
such person to the fullest extent permitted by law. Sponsor’s failure to enforce any term of these Official Rules shall not
constitute a waiver of that provision.
13. Limitations of Liability
The Released Parties are not responsible for: (1) any incorrect or inaccurate information, whether caused by entrants,
printing errors or by any of the equipment or programming associated with or utilized in the
Promotion; (2) technical failures of any kind, including, but not limited to malfunctions, interruptions, or disconnections
in phone lines or network hardware or software; (3) unauthorized human intervention in any part of the entry process
or the Promotion; (4) technical or human error which may occur in the administration of the Promotion or the
processing of entries; or (5) any injury or damage to persons or property which may be caused, directly or indirectly, in
whole or in part, from entrant’s participation in the Promotion or receipt or use or misuse of any prize. If for any reason
an entrant’s entry is confirmed to have been erroneously deleted, lost, or otherwise destroyed or corrupted, entrant’s
sole remedy is another entry in the Sweepstakes play, provided that if it is not possible to award another entry due to
discontinuance of the Promotion, or any part of it, for any reason, Sponsor, at its discretion, may elect to hold a random
drawing from among all eligible entries received up to the date of discontinuance for any or all of the prizes offered
herein. No more than the stated number of prizes will be awarded. In event that production, technical, seeding,
programming or any other reasons cause more than stated number of prizes as set forth in these Official Rules to be
available and/or claimed, Sponsor reserves the right to award only the stated number of prizes by a random drawing
among all legitimate, unawarded, eligible prize claims.
14. Disputes
Entrant agrees that: (i) any and all disputes, claims and causes of action arising out of or connected with this
Sweepstakes, or any prizes awarded, other than those concerning the administration of the Sweepstakes or the
determination of winners, shall be resolved individually, without resort to any form of class action; (ii) any and all
disputes, claims and causes of action arising out of or connected with this Sweepstakes, or any prizes awarded, shall be
resolved exclusively by the United States District Court or the appropriate California State Court located in Los Angeles
County, California; (iii) any and all claims, judgments and awards shall be limited to actual out-of-pocket costs
incurred, including costs associated with entering this Sweepstakes, but in no event attorneys’ fees; and (iv) under no
circumstances will entrant be permitted to obtain awards for, and entrant hereby waives all rights to claim punitive,
incidental and consequential damages and any other damages, other than for actual out-of-pocket expenses , and any
and all rights to have damages multiplied or otherwise increased. SOME JURISDICTIONS DO NOT ALLOW THE
LIMITATIONS OR EXCLUSION OF LIABILITY FOR INCIDENTAL OR CONSEQUENTIAL DAMAGES, SO THE ABOVE MAY NOT
APPLY TO YOU. All issues and questions concerning the construction, validity, interpretation and enforceability of these
Official Rules, or the rights and obligations of the entrant and Sponsor in connection with the Promotion, shall be
governed by, and construed in accordance with, the laws of the State of California, without giving effect to any choice
of law or conflict of law rules (whether of the State of California or any other jurisdiction), which would cause the
application of the laws of any jurisdiction other than the State of California.
15. Promotion Results
For a copy of the Winner’s List, mail a self-addressed, stamped envelope to: NBCUniversal, Inc.’s AMERICA’S GOT
TALENT WINNERS’ List Request, c/o Impact Marketing & Promotions, 19236 Cammie Lane, Tarzana, CA 91356 after
May 14, 2012. Requests received after June 14th, 2012 will not be honored.
